ATC accomplishes its goals through the objectives set forth by each of the following divisions that frame the agency. Click the section titles to learn more about the roles and responsibilities of each division.
Through the direction of Commissioner Ernest P. Legier Jr., the Office of Alcohol and Tobacco Control (ATC) is responsible for overseeing the alcoholic beverage and tobacco industries within the state. ATC also strives to assist taxpayers applying for alcohol and tobacco permits with prompt and quality service, in an effort to deliver permits in the shortest time possible. ATC is further devoted to the enforcement of the laws of the State of Louisiana to protect and safeguard all citizens.

The Business Division is responsible for processing any and all permits both in-person and via online portal. Business Division’s personnel are equipped to answer inquires and provide direction specifically relative to the permitting process and its requirement(s). Note: Team members are not permitted to determine or direct the public relative to permit type needed.

The legal division handles all ATC legal matters, including but not limited to, appeals, prosecution of administrative violations, responsible vendor violations, permit suspensions, public records requests, oppositions, and beer cash and liquor credit regulations.
It is the responsibility of the Legal division to counsel the Commissioner and the ATC divisions on interpretation of the Louisiana Alcoholic Beverage Control Law and Regulations. The Louisiana Alcoholic Beverage Control Law and Regulations and Tobacco Laws are contained in Title 26 of the Louisiana Revised Statutes and Part VII of Title 55 of the Louisiana Administrative Code. Consumable Hemp laws are contained in Title 3, Section 1481 et seq. A current version of both titles and other relevant statutory sections are available in the ATC Law Book.

Initiatives and Operations
- To provide the state with an efficient and effective regulatory system for the alcoholic beverage, tobacco and consumable hemp industries (LA Administrative Code 55, LA Revised Statutes 26 & 14).
- To provide education and underage compliance efforts to limit access of alcohol, tobacco and consumable hemp to underage individuals.
ATC’s Enforcement team is dedicated to protecting the public from danger and making the state a safer place for all Louisianans. Our agents are P.O.S.T. certified commissioned peace officers who take part in several initiatives and operations ranging from inspecting businesses for public safety violations to assisting residents during a disaster.
Business Inspections
Although all retail and wholesale business locations are required to be inspected annually, ATC’s enforcement efforts focus on high-risk locations, meaning we more frequently inspect ATC-licensed or permitted businesses that have a recent history of public safety violations. Businesses with a history of violations go on the agency’s Priority List. Types of violations include:
- Initial new business inspections and permitting.
- Fair trade practice laws.
- Improper conduct on licensed premises.
- Serving/Selling to anyone under 21.
- Overserving alcohol.
- Illegal drug activity.
- Suspected human trafficking.
Underage Compliance Operations
Underage compliance operations involve minor underage persons who enter random retail businesses undercover to identify whether the business is selling alcohol, tobacco, or consumable hemp products to minors. These operations are a valuable tool in addressing underage access to our youth. If you are a minor or a parent of a minor interested in volunteering, contact your regional enforcement director to learn more.
Special Events
ATC’s Enforcement Agents also monitor special events where alcohol is served or sold. These include music festivals, fairs, sports events, large-scale celebrations and more.
State Disaster Assistance
Agents assist local communities and fellow state agencies during times of disaster through the Governor’s Office of Homeland Security and Emergency Preparedness (GOHSEP) under Emergency Support Functions (ESF). ESF 9 Search & Rescue & ESF 13 Public Safety & Security . ATC is proud to support Louisiana communities and businesses by responding to natural or man-made disasters such as hurricanes and flooding.
